Photo: Hong Kong Government A Hong Kong online retailer's proprietor was sentenced to four months in prison on September 18 after taking payment for supermarket vouchers that were not delivered, according to [Hong Kong Customs](https://giftcard.news/organization/hong-kong-customs/). Kwun Tong Magistrates' Courts also ordered approximately HKD160,000 in compensation to five victims. [\[S01\]](#article-source-1) The conviction was for wrongly accepting payments in the course of business under the Trade Descriptions Ordinance. The official announcement does not name the retailer, its proprietor or the supermarket whose vouchers were advertised. ## Payments, nominal voucher value and court-ordered compensation The data behind the story ### Three distinct monetary measures in the voucher case The case covered 4,380 vouchers of HKD50, approximately HKD170,000 paid and approximately HKD160,000 in compensation ordered. [\[S01\]](#article-source-1) The case involved 4,380 supermarket vouchers and approximately HKD170,000 in aggregate payments, with the largest individual case around HKD70,000\. Those reported payments are different from the vouchers' nominal spending value. Multiplying the stated quantity by HKD50 produces HKD219,000 in face value, while the compensation order was approximately HKD160,000\. None of those figures should be used interchangeably. The announcement does not explain the difference between total case payments and ordered compensation, or confirm that the compensation has been paid. It also does not provide the dates of the underlying sales. The September 18 news is the conviction and sentence, rather than the start of the presale operation. It does not report a defect in issued vouchers, a supermarket insolvency, compromised gift-card codes or a counterfeit-card investigation. Customs explained that the ordinance covers a trader accepting payment while intending not to supply a product, or without reasonable grounds to believe it can be supplied within the stated or a reasonable period. This is the authority's account of the rule applied in the case, rather than a newly introduced voucher law.
